Terms of service
These terms apply to the Flexpatch Android app and the Flexpatch Premium subscription. Flexpatch is made by an independent developer ("Flexpatch", "we", "us"). By installing or using the app, you agree to these terms. If you don't agree, please don't use the app.
1. Not affiliated with Amazon
Flexpatch is an independent app. It is not affiliated with, endorsed by or sponsored by Amazon. Amazon and Amazon Flex are trademarks of Amazon.com, Inc. or its affiliates. We mention them only to describe the app that Flexpatch works with. Amazon is not responsible for Flexpatch, and we can't help with your Amazon Flex account, blocks or pay.
2. Who can use Flexpatch
You must be at least 18 years old. Flexpatch is offered in the United States only.
3. Your responsibilities
- Amazon Flex rules. You are responsible for following the Amazon Flex terms, program policies and any instructions Amazon gives you. Read them and decide for yourself whether to use Flexpatch. We make no promise about how Amazon views third-party apps, and we are not responsible for any action Amazon takes on your account.
- Driving safely and legally. Obey traffic laws and road signs, and use your judgement on the road. Set up your route before you drive. Don't handle your phone while driving unless it is safe and legal where you are.
- Your deliveries. You stay responsible for your deliveries, including Amazon's delivery instructions, time windows and the order Amazon requires for any stop.
- Automatic rules. Automatic features, such as auto-capture, run only after you turn them on. You can stop them at any time.
4. Route suggestions are not guaranteed
Stop orders, travel times, distances, savings and arrival estimates are suggestions based on map data and the information Flexpatch could read from the Flex app. They may be wrong or incomplete. For example, they don't include live traffic, and they may not reflect road closures, turn or vehicle restrictions, gate codes, building access or a misplaced address. We don't guarantee that a suggested route is faster, shorter, legal or safe, or that it meets every time window. Check addresses and directions yourself.
Flexpatch depends on how the Amazon Flex app looks and works. If Amazon changes its app, capture may stop working fully or partly until we update Flexpatch.
5. Flexpatch Premium subscription
- What it includes: route optimisation, manual stop re-ordering, and driving mode (the floating bubble and progress notification). Other features are free.
- Price: $9.99 per month in US dollars, plus any applicable taxes, or the price shown in Google Play when you subscribe.
- Billing: payments are handled by Google Play Billing and charged to your Google Play account. We don't process or store your payment details.
- Auto-renewal: the subscription renews automatically every month and is charged at the start of each period, until you cancel.
- Free trial: new subscribers can get a 1-week free trial, where Google Play offers it (one trial per Google account). Unless you cancel before the trial ends, it automatically becomes a paid subscription and your first payment is charged.
- Cancelling: cancel any time in the Google Play Store under Payments & subscriptions › Subscriptions. Premium stays active until the end of the period you've already paid for, and you won't be charged again. Uninstalling the app does not cancel the subscription.
- Refunds: refunds are handled under Google Play's refund policies. You can request one through Google Play. Except where the law requires, we don't give refunds or credits for partly used periods.
- Price changes: if the price changes, Google Play will notify you in advance as its rules require, and you can cancel before the new price applies.
6. Service availability
Route optimisation uses the Flexpatch server. The server may sometimes be slow or unavailable, for example during maintenance or an outage. When it can't be reached, the app works out an estimated route on your phone and labels it "estimated". These are rougher than server routes. We don't promise that the server, or any feature, will be available at any particular time. We may change, add or remove features. Optimisation requests are limited (currently up to 200 stops per request and 60 requests per hour) to keep the service fair for everyone.
7. Using the app
We give you a personal, non-exclusive, non-transferable licence to use Flexpatch on Android devices you own or control, for your own deliveries, under these terms and Google Play's terms. You agree not to:
- copy, resell or redistribute the app or its subscription;
- access the Flexpatch server other than through the app, or try to get around its subscription checks or limits;
- interfere with, overload or attack the server or other users;
- use Flexpatch for anything unlawful.
Flexpatch, its name, logo and app are owned by us. Map data © OpenStreetMap contributors. Map tiles are provided by OpenFreeMap.
8. Third-party services
Flexpatch relies on services we don't control, including Google Play, Android's Geocoder, RevenueCat, OpenFreeMap, OpenStreetMap data, and the navigation app you choose. Their own terms apply to your use of them, and we aren't responsible for them. Our privacy policy explains what information goes to each.
9. Disclaimer
Flexpatch is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost earnings, lost blocks, account deactivation, late or missed deliveries, traffic tickets, vehicle damage or accidents, arising from your use of Flexpatch or your reliance on its suggestions. Our total liability for any claim relating to Flexpatch is limited to the amount you paid for Flexpatch Premium in the 12 months before the claim. Some states don't allow some of these limits, so they may not all apply to you.
11. Ending use
You can stop using Flexpatch at any time by uninstalling it. Cancel any subscription in Google Play as well. We may suspend access to the server if these terms are broken, for example by abusing the server.
12. Governing law
These terms are governed by the laws of the United States and the state of Pennsylvania, without regard to conflict-of-law rules.
13. Changes to these terms
We may update these terms. We'll post the new version on this page with a new effective date, and tell you in the app if a change is significant. If you keep using Flexpatch after a change, you accept the new terms. If you don't agree, stop using the app and cancel your subscription.
